Terms and conditions
Additionally, the Hello From Anywhere Web Sites may themselves contain additional terms that govern particular features or offers (for example, sweepstakes or chat areas). In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular Hello From anywhere Web Site, then these terms shall control.
Agreement To Rules Of User Conduct
You agree to abide by hello From Anywhere Corporation's Rules of User Conduct, including but not limited to, agreeing not to use the Hello From Anywhere Web Sites for any unlawful purpose.
Third Party Sites
The Hello From Anywhere Web Sites may produce automated search results or otherwise link you to other sites on the Internet. These sites may contain information or material that some people may find inappropriate or offensive. These other sites are not under the control of Hello From Anywhere Corporation, and you acknowledge that Hello From Anywhere Corporation is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. The inclusion of such a link does not imply endorsement of the site by Hello From Anywhere Corporation or any association with its operators.
Proprietary Rights
You acknowledge and agree that all content and materials available on the Hello From Anywhere Web Sites are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by Hello From Anywhere Corporation, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content. Limitation of Liability
Under no circumstances shall Hello From Anywhere Corporation, its subsidiaries, or its licensors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, the Hello From Anywhere web sites. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Hello From Anywhere corporation has been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, Hello From Anywhere Corporation’s liability in such jurisdictions shall be limited to the extent permitted by law.
Indemnification
Upon a request by Hello From Anywhere Corporation, you agree to defend, indemnify, and hold harmless Hello From Anywhere Corporation and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees that arise from your use or misuse of the Hello From Anywhere Web Sites. Hello From Anywhere Corporation reserves the right, at it own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Hello From Anywhere Corporation in asserting any available defenses.
International Use
Hello From Anywhere Corporation makes no representation that materials on the Hello From Anywhere Web Sites are appropriate or available for use in locations outside the Netherlands, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access the Hello From Anywhere Web Sites from other locations do so on their own initiative and are responsible for compliance with local laws.
Choice of Law & Forum
These Terms of Use shall be governed by and construed in accordance with the laws of the State of The Netherlands, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
Severability And Integration
Unless otherwise specified herein, this agreement constitutes the entire agreement between you and Hello From Anywhere Corporation with respect to the Hello From Anywhere Web Sites and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and Hello From Anywhere Corporation with respect to the Hello From Anywhere Web Sites. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
Termination
Hello From Anywhere Corporation reserves the right, in its sole discretion, to terminate your access to all or part of the Hello From Anywhere Web Sites, with or without notice.
1. Definitions
The Card is a prepaid card. The Card allows you to access funds you place on the Card. The Card is not connected in any way to any other account. The Card is not a credit card. You will not receive any interest on your funds on the Card. The funds on your Card are FDIC insured; BANKFIRST, Member FDIC. Our business days are Monday through Friday excluding holidays. Saturday, Sunday, and federal holidays are not considered business days, even if we are open.
Authorized Users
You may request an additional Card for another person. You may also permit another person to have access to your Card or Card number. However, if you do, you are liable for all charges made by those persons. You are responsible for all charges and fees incurred by any other person you have authorized. You are wholly responsible for the use of each Card according to the terms of this Agreement.
Personal Identification Number (PIN)
We will give you a Personal Identification Number ("PIN"). If you believe that anyone has gained unauthorized access to your PIN, you should advise us immediately, following the procedures in the paragraph labeled "Your Liability for Unauthorized Transfers."
Loading Your Card
Loading Your Card You may add money to your Card or Cards, called "value loading", at any time up to the limit of €1,000 per load. Some loading locations may impose a lower limit. There is no limit on the number of times you may value load your Card but the maximum amount that can be loaded onto the Card or Cards in one day is €1,000. The maximum number of loads per day to your Card is unlimited. The minimum amount that can be loaded onto your Card is €1,30. The maximum value your Card may have at any time is €2,500. All money loaded on the Card(s) must be in Euros, and your balance and use fees will be calculated in Euros. For purposes of this agreement, you agree that your Card(s) is issued in Euros. Each time you load value to the Card, you authorize us to increase the value on the Card by the amount of the transaction less applicable fees.
2. Using Your Card
You may use your Card to purchase or lease goods and services wherever Maestro cards are accepted as long as you do not exceed the value available on your Card. You are responsible for all authorized transactions initiated by use of your Card. If you permit someone else to use your Card we will treat this as if you have authorized such use and you will be responsible for any transactions made subject to such use.
Some merchants do not allow cardholders to conduct split transactions where you would use the card as partial payment for goods and services and paying the remainder of the balance with another form of legal tender.
For security reasons, we may limit the amount or number of transactions you can make on your Card. Your Card cannot be redeemed for cash. You may not use your Card for any illegal transaction.
Each time you use your Card, you authorize us to reduce the value available on your Card Account by the amount of the transaction plus applicable fees. You are not allowed to exceed the available amount on your Card Account through an individual transaction or a series of transactions. Nevertheless, if a transaction exceeds the balance of the funds available on your Card you shall remain fully liable to us for the amount of the transaction and any applicable fees or charges.
You do not have the right to stop payment on any purchase or payment transaction originated by use of your Card. You may not make preauthorized regular payments from your Card Account. If you authorize a transaction and then fail to make a purchase of that item as planned, the approval may result in a hold for that amount of funds for up to 10 days (or up to 30 days for car rentals, hotel and airline purchases).
3.Returns and Refunds
If you are entitled to a refund for any reason for services obtained with your Card, you agree to accept credits to your Card for such refunds, except in the event of a full refund of all remaining balances and/or original purchase price. In such an event, you will receive a check for the applicable amount from Hello From Anywhere Financial Services LLC and your Card will be cancelled.
4. Closing a Cash 2Go Account/Request Funds
You may close your Account at any time. When closing your Account, we will not return to you all available funds, net of fees. You will incur a charge for each check mailed, to cover processing costs. The amount of the charge is shown in the Fee and Charges section. Checks can only be paid to the order of the primary account holder. At our discretion, we may close your Account(s) and disburse your funds at any time and for any reason, with no charge to you.
5. Foreign Transactions
If you obtain your funds in a currency other than the currency in which your Card was issued, the Issuer will increase the currency conversion rate (described in the immediately preceding section) by an additional 2.5% and will retain this amount as compensation for its services.
6. Amendment and Cancellation
We may amend or change the terms of this Agreement at any time. You will be notified of any change in the manner provided by applicable law prior to the effective date of the change. However, if the change is made for security purposes, we can implement such change without prior notice.
We may cancel or suspend your Card or this Agreement at any time. You may cancel this Agreement by notifying us in writing and returning all Cards to us. Your termination of this Agreement will not affect any of our rights or your obligations arising under this Agreement prior to termination.
7. Card Expiration
Your Card will expire three (3) month from the date that you start use it. After that date you will not be able to use the Card. If you still have funds remaining on the Card record after the expiration date, contact us within ninety (90) days of card expiration at the customer care telephone number in this Agreement. If you do not contact us within ninety (90) days following expiration, the credit remains will be expiration. Any remaining balance will be handled in accordance with applicable law.
8. Information About Your Right to Dispute Errors
If you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt. You must contact us no later than sixty (60) days after we have sent you the FIRST statement on which the problem or error appeared.
- 1. Provide your name and Card number (if any).
- 2. Describe the error or the transaction you are unsure about, and explain why you believe it is an error or why you need more information.
- 3. Provide the Euro amount of the suspected error.
- 4. Proof or documentation of error will be required.
